Equipment Disclaimer
By purchasing and/or using Capefree equipment, you understand and accept that ground handling a paraglider (also called kiting) is a demanding and dangerous activity which may result in injury or death. You accept that self-training greatly increases your chances of injury or death. Prior to equipment use, you understand and agree to obtain certified training, and agree to wear a helmet and other protective gear whenever you are using our equipment. You also understand and accept that Capefree equipment is not certified, nor designed, manufactured and/or tested to any federal, state or organizational standard. You also accept that Capefree equipment is for ground use only and is not flight worthy – not intended for flight. In short, you agree not to use any of our equipment for flight. By purchasing and using our equipment, you also assume all risk, including harm to self, harm to others, equipment damage, and/or property damage. You accept that Capefree.com, Capefree, Leaping Limited, owners, sellers, manufacturers, designers, representatives, employees, and/or contractors are not liable for any physical, emotional, and/or financial harm that you may experience from purchasing and/or using our equipment.
Referral Program
Capefree offers a referral program (“Program”) for individuals aged 18 or older, subject to approval at Capefree’s sole discretion. Each approved participant will receive one unique referral code, which may not be altered or transferred without written authorization. Referral codes must be used at the time of checkout to be valid. Commissions are limited to qualifying purchases of harnesses and wings; all merchandise, including apparel and accessories, is excluded. Participants earn a commission equal to 10% of the qualifying purchase total when their referral code is used, with payouts issued after a 30-day return period to account for customer returns. Payouts are made via Zelle (preferred) or PayPal, and any transaction or processing fees incurred are the responsibility of the participant. Any attempt to misuse, manipulate, or engage in fraudulent activity within the Program will result in immediate removal and forfeiture of unpaid commissions. Capefree reserves the right to modify, suspend, or terminate the Program at any time, for any reason, including but not limited to prolonged inactivity. Additionally, Capefree retains the right to remove any participant from the Program at its sole discretion, with or without cause. Participation in the Program is voluntary and at the participant’s own risk. Capefree shall not be liable for any indirect, incidental, or consequential damages arising out of or related to participation in the Program.
In Perpetuity
You understand and agree to fully and forever discharge us from all liability, claims, suits and/or legal actions. You further agree not to assist anyone filing suits and/or claims against us, and waive all non-assisted claims and/or suits against us. You further agree to indemnify, defend and hold harmless Capefree, Capefree.com, Leaping Limited, owners, sellers, heirs, designers, employees, contractors, manufacturers and/or representatives from any claim or suit. If, however, any legal claims are still filed against us (directly by you or indirectly by a third party), you agree to pay any and all our legal fees and damages arising from a breach in this agreement.
Shipping
By purchasing Capefree equipment, you understand and accept that we do not guarantee delivery time, and we are not accountable for delays in shipping or for items that are damaged by the delivery provider.
Exchanges, Returns and Refunds
We sincerely appreciate your support, and we strive to be fair to all our customers. As a result, exchanges, returns and refunds are handled on a case by case basis. We, however, do not grant exchanges, refunds or partial refunds past 30 days, nor do we process anything without prior approval. Do not send us your order without our approval; it will not be processed. Instead, if you wish to return or exchange an item, start by emailing us explaining the issue. We will reply to your email, and may ask some follow up questions. Please note: if we approve your request, we do not refund payment processing fees, and you may also incur restocking fees if the item can't be resold for its original cost. You are also responsible for return shipping costs. If approved, however, you will need to securely pack the item and return the item to the below address. The item needs to be in the same condition as compared to when the item was shipped. Broken, altered, dirty and used items will not be accepted. If an item is damaged in transit, you will handle the claim before we provide a refund or exchange. Claims are governed by your delivery provider.
Refusal
Capefree reserves the right to refuse any order you place with us. If we cancel an order, we will return your payment and email you.
